一、勞動(dòng)合同原文樣本：
根據(jù)《中華人民共和國(guó)勞動(dòng)法》和中國(guó)其他有關(guān)法律、法規(guī)， （以下簡(jiǎn)稱甲方）和 （以下簡(jiǎn)稱乙方），在平等、自愿及相互協(xié)商之基礎(chǔ)簽訂本合同，并共同遵守本合同所列條款。
1合同類別和期限
1.1本合同為固定期限的勞動(dòng)合同。
1.2本合同期限為 年。自 年 月 日起至 年 月 日止。
2工作內(nèi)容
2.1 乙方自愿受聘于甲方。乙方同意根據(jù)甲方工作需要，擔(dān)任甲方 職位。
3雙方的權(quán)利和義務(wù)
3.1 甲方的權(quán)利
?。?）按照崗位責(zé)任組織管理，檢查考核乙方完成（工作）任務(wù)；
?。?）按照國(guó)家法律、法規(guī)和本單位有關(guān)規(guī)定，決定對(duì)乙方勞動(dòng)報(bào)酬的分配形式，并對(duì)乙方實(shí)施獎(jiǎng)勵(lì)和處分；（北京翻譯 推薦整理）
?。?）根據(jù)甲方本身業(yè)務(wù)需要，在乙方專業(yè)知識(shí)和技能范圍內(nèi)，對(duì)乙方的工作崗位進(jìn)行調(diào)整；
?。?）甲方根據(jù)經(jīng)營(yíng)管理的需要，有權(quán)隨時(shí)合理地修訂其規(guī)章制度。并可用其認(rèn)為恰當(dāng)?shù)娜魏畏绞剑òǖ幌抻谕ㄖ?、通告、電子郵件、備忘錄和員工手冊(cè)等）通知乙方；
?。?）當(dāng)乙方不履行本合同時(shí)，甲方有權(quán)按第8條規(guī)定解除合同。
?。?）當(dāng)乙方違反本合同規(guī)定的義務(wù)，甲方有權(quán)依據(jù)當(dāng)?shù)胤杉凹追揭?guī)章制度追究責(zé)任。
3.2 甲方的義務(wù)
?。?） 按照有關(guān)勞動(dòng)安全，勞動(dòng)保護(hù)、職業(yè)安全等的規(guī)定，向乙方提供必需的安全健康的工作環(huán)境，同時(shí)為乙方能夠完成本合同規(guī)定的義務(wù)提供相應(yīng)的工作條件；
?。?） 根據(jù)有關(guān)中國(guó)國(guó)家有關(guān)規(guī)定及本合同有關(guān)條款，按時(shí)支付乙方勞動(dòng)報(bào)酬并提供保險(xiǎn)福利待遇；成績(jī)證明書案例：
（3） 甲方每年組織乙方進(jìn)行一次健康檢查。
3.3乙方的權(quán)利
（1）按照規(guī)定領(lǐng)取報(bào)酬和享受相關(guān)的保險(xiǎn)福利待遇；
?。?）享受業(yè)務(wù)（技術(shù)）學(xué)習(xí)（培訓(xùn)）機(jī)會(huì)；
?。?）享有休息、休假和獲得勞動(dòng)安全衛(wèi)生保護(hù)的權(quán)利；
?。?）甲方不履行本合同時(shí)，乙方可以依據(jù)本合同第8條約定解除；
?。?）甲方違反合同約定時(shí)，乙方有權(quán)依法向勞動(dòng)爭(zhēng)議仲裁委員會(huì)提起申訴。
3.4 乙方的義務(wù)
?。?）在工作期間內(nèi)，將全部精力投入到崗位職責(zé)所要求的各項(xiàng)義務(wù)中，還應(yīng)完成甲方為其安排的本崗位以外的臨時(shí)性工作，盡最大努力協(xié)助甲方達(dá)到或超出預(yù)期的商業(yè)計(jì)劃；
?。?）遵守國(guó)家法律、法規(guī)和社會(huì)公德，保守甲方的技術(shù)秘密和商業(yè)秘密，愛護(hù)甲方財(cái)物；
?。?）遵守甲方規(guī)定的勞動(dòng)紀(jì)律、操作規(guī)程和內(nèi)部規(guī)章制度，遵守職業(yè)道德；
?。?）努力學(xué)習(xí)專業(yè)知識(shí)，不斷提高業(yè)務(wù)能力，以勝任本崗位工作。
4.工作時(shí)間甲方根據(jù)國(guó)家法律、法規(guī)和本單位的工作實(shí)際，實(shí)行每周五天工作日，每日工作時(shí)間8小時(shí)，平均每周工作時(shí)間不超過40小時(shí)。
5.勞動(dòng)報(bào)酬
5.1 甲方支付乙方的薪金由工資和津貼兩部分構(gòu)成。其中工資又分為基礎(chǔ)工資、崗位工資和浮動(dòng)工資三部分。甲方根據(jù)乙方的學(xué)歷、工齡、技能和崗位職責(zé)確定乙方的工資標(biāo)準(zhǔn)。
5.2依照甲方的經(jīng)濟(jì)效益和乙方的工作業(yè)績(jī)確定乙方的獎(jiǎng)金金額。發(fā)放形式、時(shí)間、標(biāo)準(zhǔn)由甲方根據(jù)內(nèi)部規(guī)章制度確定。
5.2甲方每月月底將報(bào)酬金額劃入乙方指定的銀行個(gè)人工資賬戶中。

（hereinafter referred to as “PARTY A”） and __________（hereinafter referred to as “Party B”） enter into this Contract through mutual friendly negotiation in principles of equality and voluntariness subject to the Employment Contract Law of the People’s Republic of China as well as other related Chinese laws and regulations, and both parties agree to observe the following terms and conditions.
1 Title and Term of Contract
1.1 This Contract is a fix-term employment contract.
1.2 This Contract shall remain effective for ________ years from ____ （MM）______（DD）______（YY） to ____ （MM）______（DD）______（YY）。
2 Job Description
2.1 Party A voluntarily accepts the appointment of Party A to be Party A’s _________ according to the requirements of Party A’s job.
3 Rights and Obligations of Both Parties
3.1 Rights of Party A
（1） to conduct organization and management as well as inspect and examine the task （work） finished by Party B according to post responsibilities;
?。?） to decide on the form of distribution of Employment Contract remuneration for Party B and give awards as well as punishments to Party B subject to relevant provisions of laws and regulations as specified by the state and those formulated by this unit;
?。?） to make adjustment to Party B’s job in consideration of the professional knowledge and skills of Party B according to the requirements of Party A’s own businesses;
?。?） to be entitled to revise Party A’s rules and regulations from time to time by Party A according to the requirements of its operation and management, and to inform Party B of matters （including but not limited to any notice, announcement, email, memorandum and employee manual） by any means deemed appropriate by Party A;
?。?） to have the right to terminate this Contract pursuant to Article 8, should Party B fail to perform this Contract; and
（6） to enjoy the right to investigate Party B for responsibility in compliance with local laws as well as Party A’s rules and regulations in case Party B contravenes its obligations hereunder.
3.2 Obligations of Party A
?。?） to provide Party B with necessary, safe and healthy working environment according to relevant provisions on Employment Contract safety, Employment Contract protection and occupational safety, and to furnish corresponding working conditions for Party B to fulfill its obligations hereunder at the same time;
?。?） to Party B the Employment Contract remuneration on time and provide Party B with insurance benefits in conformity with relevant provisions stipulated by the State and pertinent terms and conditions hereof; and
?。?） to organize a medical examination on a yearly basis for Party B.
3.3 Rights of Party B
?。?） to collect remuneration and enjoy pertinent insurance benefits according to provisions;
（2） to enjoy opportunities of vocational （technology） study （training）；
（3） to have the rights of enjoying rest and holidays as well as acquiring the protection of Employment Contract safety and health;
?。?） to have the right to terminate this Contract in accordance with Article 8 in the event that Party A fail to perform this Contract; and
（5） to be entitled to legally file an application for arbitration before an arbitration commission of Employment Contract disputes if Party A contrives this Contract.
3.4 Obligations of Party B
?。?） to finish temporary work assigned by Party A in addition to Party B’s own job and give assistance to Party A in realizing or going beyond intended business programs to the best of abilities of Party B, besides putting whole soul into various obligations required by post responsibilities;
（2） to observe laws and regulations stipulated by the State social ethics, keep confidential Party A’s technological know-how and business secrets and protect Party A’s property;
?。?） to comply with Employment Contract disciplines, operating instructions and internal rules as well as regulations and adhere to professional ethics; and
?。?） to study hard the professional knowledge, keep improving professional ability so as to be equal to its own job.
4 Working Hours
The working hours that Party B is required to follow by Party A in accordance with State laws and regulations as well as the actual conditions of this unit is five days a week, with 8 eight hours each day and no more than 40 hours in all for a week.
5 Employment Contract Compensation
5.1 The salary paid by Party A to Party B shall be composed of such two parts of wages and allowances. Such wages shall be divided into three parts like basic wage, job wage and floating wage. Party A shall, according to the educational background, length of service, skills and post responsibilities of Party B, determine the standards of wages paid to Party B;
5.2 The amount of bonus for Party B shall be decided according to Party A’s economic returns and the job performance of Party B. Party A shall, based on the internal rules and regulations, make decision on the forms, time, standards of bonus distribution;
