　　根據(jù)國家和省法律、法規(guī)和有關(guān)規(guī)定，買受人和出賣人在平等、自愿、協(xié)商一致的基礎(chǔ)上就買賣商品房達成如下協(xié)議：

　　In accordance with Contract Law of the Peoples Republic of China, Law of the Peoples Republic of China on Urban Real Estate Administration and pertinent laws and regulations, the seller and buyer, based on equality, voluntariness and negotiated consensus, hereby conclude the following agreement on the purchase and sale of commodity house:

　　第一條項目建設(shè)依據(jù)。

　　Article 1 Basis for project construction

　　出賣人以 出讓 方式取得位于xxxxxxxxxxx 編號為xxx的地塊的土地使用權(quán)，取得《土地使用權(quán)證書》。土地使用權(quán)證號為x國用（xxxx）第xxxx號。

　　The seller obtained the use right of the land parcel ocated located xxxxxxxxxxxxxxxxx with  No.xxx by transfer.  The number of Assignment Contract of the Use Right of the Land is xxxx-xxxx.

　　該地塊土地面積為xxxx平方米，規(guī)劃用途為 商住 ，土地使用權(quán)年限自2011 年至2061 年。

　　The area of this land parcel is xxxxm2 , its planned use is for commercial and residential , the land use period is from 2011 to 2061.

　　出賣人經(jīng)批準，在上述地塊上建設(shè)商品房，【現(xiàn)定名】xxxxxxxx。建設(shè)工程規(guī)劃許可證號為xxxxxx，施工許可證號為xxxxxx 。

　　Upon examination and approval, the seller built commercial building on the land parcel. The building present name is xxxxxxxx. the No. of Permit for A Planned Construction Project is No.xxxxxx, The Construction Permit No. is xxxxxx.

　　第二條商品房銷售依據(jù)。

　　Article 2 Basis for Sale of Commodity House

　　買受人購買的商品房為【現(xiàn)房】【預售商品房】。預售商品房批準機關(guān)為 xx縣房地產(chǎn)管理所，商品房預售許可證號為xxxxxxx 號。

　　The commodity house purchased by the buyer is pre-sale commodity house. The pre-sale of the commodity house is approved by xxxx County Real Estate Management Bureau, the No. of Pre-sale Permit of Commodity House is No. xxxxxxx.

　　第三條買受人所購商品房的基本情況。

　　Article 3 General Information of the Commodity house purchased by the buyer

　　該商品房的用途為 住宅 ，屬混合結(jié)構(gòu) 結(jié)構(gòu)，層高為x米 ，建筑層數(shù)地上x 層，地下x 層。

　　This commercial building is used for residence. It has steel concrete structure. The height per floor is xm, it has x floors over ground and x floors underground.

　　該商品房合同約定建筑面積共xx 平方米，其中，套內(nèi)建筑面積 平方米，公共部位與公用房屋分攤建筑面積 平方米（有關(guān)公共部位與公用房屋分攤建筑面積構(gòu)成說明見附件二）。

　　The floor area of this commodity house[ agreed in contract] is totally xx m2 in details, the indoor floor area is  m2, and the sharing floor area for public places and public housing is   m2  , （ see attachment 2 to this contract for the constitution of the sharing floor area for public places and public housing）

　　第四條計價方式與價款。

　　Article 4 Charging Method and Price

　　出賣人與買受人約定按建筑面積計算，該商品房單價為（人民幣）每平方米_xxxx_ __元，總金額為（小寫）xxxx元整，（大寫）xxxxxxxxxxxxxxx整，幣種為人民幣。

　　The seller and the buyer agree to calculate the price of this commodity house in

　　in terms of floor area, the unit price for this commodity house is （Currency: RMB） xxxxYuan per square meter, and the total price is （RMB） xxxxxx Yuan only.

　　第十九條　本合同在履行過程中發(fā)生的爭議，由雙方當事人協(xié)商解決；協(xié)商不成的，按下述第_2_種方式解決：

　　Article 19 the disputes incurred in performing this contract shall be settled by both parties upon negotiation; if the negotiation fails, settle it in second method as follows:

　　1.提交___xxx__仲裁委員會仲裁。

　　2.依法向人民法院起訴。

　　1.submit to arbitration committee for handling

　　2.file a lawsuit to people’s court in accordance with law.

　　Article 20 in case of unmentioned matters by this contract, both parties shall make agreements and conclude supplementary agreement （ attachment 4）

　　第二十一條　合同附件與本合同具有同等法律效力。本合同及其附件內(nèi)，空格部分填寫的文字與印刷文字具有同等效力。

　　Article 21 each attachment to this contract has the same legal force with this contract. In this contract and the attachments thereof, the handwriting content in blank lines has the same legal force with the printing text.

　　第二十二條　本合同連同附件共__xx_頁，一式 x 份，具有同等法律效力，合同持有情況如下：

　　Article 22 this contract has 16 pages in total and has 5 copies with the same legal force. The detailed situation is as follows:

　　第二十三條　本合同自雙方簽訂之日起生效。

　　Article 23 this contract takes effect upon date of conclusion by both parties.

　　第二十四條　商品房預售的，自本合同生效之日起30天內(nèi)，由出賣人向 xx縣房地產(chǎn)管理所申請登記備案。
